Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the website, products, and same-day package delivery services (collectively, the "Service") offered by Rushly ("Rushly," "we," "us," or "our"). By placing an order or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Rushly provides same-day delivery of care packages, bags, and letters to missionaries at the Provo Missionary Training Center (the "MTC"). You place an order online and drop your item at one of our partner locations in Utah; we deliver it to the MTC the same business day when it is dropped off before that location’s posted cutoff time.

We deliver Monday through Friday, excluding holidays. Items dropped off after a location’s cutoff, or on a weekend or holiday, are delivered the next business day.

2. Eligibility

You must be at least 18 years old, or have the consent and supervision of a parent or legal guardian, to place an order. By using the Service, you represent that the information you provide is accurate and that you are authorized to send the item you submit.

3. Orders and Drop-Off

When you place an order, you are responsible for providing accurate recipient information, including the missionary’s full name and MTC details. Rushly is not responsible for delivery failures caused by incomplete or inaccurate information. Cutoff times and partner store hours are posted on our Locations page and may change.

4. Prohibited Items and MTC Guidelines

All packages must comply with the official Provo MTC package guidelines and applicable law. You agree not to send prohibited, perishable, hazardous, illegal, or otherwise restricted items. The MTC’s guidelines are available here. We may, in our sole discretion, refuse, hold, or return any item we reasonably believe violates these guidelines or these Terms, and we are not liable for items rejected by the MTC.

5. Pricing and Payment

Prices are shown at checkout and depend on the size of your package; letters and cards may be sent free of charge where indicated. Payments are processed securely by our third-party payment processor, Stripe. Rushly does not store your full payment card details. You are responsible for any applicable taxes.

6. Cancellations and Refunds

Because delivery is same-day and time-sensitive, an order generally cannot be canceled once your item has been picked up from a partner location. If we are unable to deliver your item for a reason within our control, contact us and we will work with you on a refund or re-delivery. Refunds are issued to the original payment method.

7. Delivery, Risk, and Delays

We make reasonable efforts to deliver every item on time. We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including incorrect recipient information, MTC policies or closures, weather, or other events outside our operations. Risk of loss for an item passes once it is accepted at the MTC.

8. Partner Locations

Drop-off locations are independently owned and operated businesses with their own hours, staffing, and policies. Rushly is responsible for delivery from the partner location to the MTC, but is not responsible for the products, services, or conduct of partner businesses.

9. Your Responsibilities

You agree to use the Service only for lawful purposes, to provide accurate information, and not to send anything on behalf of another person without their authorization or in violation of these Terms or MTC guidelines.

10. Intellectual Property

The Service, including the Rushly name, logo, website, and content, is owned by Rushly and protected by intellectual property laws. You may not copy, modify, or use our branding without our prior written permission.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

12. Limitation of Liability

To the fullest extent permitted by law, Rushly and its owners, employees, and partners will not be liable for any indirect, incidental, special, or consequential damages, or any loss arising from your use of the Service. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

13. Indemnification

You agree to indemnify and hold harmless Rushly from any claims, losses, or expenses arising out of your use of the Service, your violation of these Terms, or your submission of any prohibited or unlawful item.

14. Changes to the Service and Terms

We may update the Service or these Terms from time to time. Changes take effect when posted on this page, and the "Last updated" date above will reflect the most recent revision. Your continued use of the Service constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Utah.
